KuluBadu Plus (Pvt) Ltd. (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our mobile application (the “Application”). Please read this Privacy Policy carefully.

Welcom to KuluBaduPlus (Pvt) Ltd. and thank you for joining us! It is important that you review this agreement because, by accessing this website, mobile application and placing an order with us, you are agreeing to the terms and conditions that govern the use of these applications and terms upon which we agree to deliver to you.

By placing an order with us online, you agree to the terms of this Agreement (the “Agreement”) which shall cover the terms of our deliveries to you and your use of our mobile application. This Agreement is between you and KuluBadu Plus (Pvt) Ltd. (the “Company” or “KuluBadu Plus”) that states the terms and conditions under which you may use the Site and receive deliveries from us.  KuluBadu Plus is the owner of the following trademarks: KuluBadu Plus, www.KuluBaduPlus.com, and the KuluBadu Plus logo. This Agreement is binding on you when you purchase from us.

TERMS AND CONDITIONS OF ONLINE SHOPPING

These terms and conditions apply to purchases made on KuluBaduPlus mobile application (app).  All orders placed through this app are subject to confirmation and acceptance 
by us. All prices are in Sri Lankan Rupees.

ORDERS AND DELIVERY


KuluBadu Plus or its agent will deliver the goods you order to the address you specify in your order, within the agreed time frame, subject to their availability. Anyone at the delivery address who receives the goods will be presumed by KuluBadu Plus to be authorized to receive the goods. You must ensure that a person over the age of 16 years is available to accept delivery of the goods.  If there is no-one at the delivery address or no-one of appropriate age to receive the order, we may charge you additional delivery fees. Once the goods are delivered to you, you will own them and it is your responsibility if they are lost or damaged.

We guarantee next day delivery on orders received before 7pm.

RETURNS AND REPLACEMENTS

In the rare event that an item is flawed, damaged or defective upon delivery, please notify our delivery agent and he will make the necessary arrangements to correct it by way of a refund or a next day replacement.

If you are not satisfied with the handling of the situation by our agent, please contact us within 24 hours quoting receipt number and your reason for dissatisfaction.

If an item(s) needs to be returned, please contact us.  The returned item(s) has to be non-perishable and in new, unused, condition and in its original packaging.  KuluBadu Plus reserves the right, not accept any returns requested after the delivery is completed.  Please note that additional transportation charges may apply.

PRICES AND PAYMENT


For each online order, you must pay 
the applicable price for the relevant goods confirmed by KuluBadu Plus and applicable delivery and handling fees specified on the web site/app at that time.

Your order and credit card details are safe and secure. KuluBadu Plus does not store any financial information, all such information is routed directly to the bank and they take all the needed security measures that they are required to take. All personal information provided to KuluBadu Plus is encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data as it travels over the internet.

Currently we accept credit card and cash on delivery (COD) payments. 

YOUR ACCOUNT 


We take utmost care to protect your login information.  However you are liable to protect your log-in information on your end, to prevent unauthorized use.  You agree to release and indemnify KuluBadu Plus in connection with any use (whether authorize or unauthorized) of your login.

To create a new account a valid email address and a Sri Lanka phone number (that is not already being used to access this app) is required.

KuluBadu Plus reserves the right to suspend or cancel your account at any time without prior notice.

RESET PASSWORD 


To reset a password via "forgot password" we will require you to use the email and the phone number that we have on record in your profile.  If resetting the password by calling us we might require some additional information to verify your identity.  We will never ask for any sensitive information such as credit card numbers, passwords or PINs.

LOST OR STOLEN PHONES 


In the case of lost or stolen telephone we highly recommend that you contact us to block/deactivate your account so that no fraudulent purchases are made with your device.


COPYRIGHT AND OWNERSHIP

All Site content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are the property of, or duly licensed to, KuluBadu Plus (Pvt) Ltd.  Consent is granted to view all such items for the sole purpose of placing an order with us.  You are not authorized to save or collect any such information.  Any other use of materials on this Site, including modification, distribution, or reproduction is strictly prohibited.  You acknowledge that KuluBadu Plus and/or third-party content providers remain the owners of such material and that you do not acquire any of those ownership rights by downloading copyrighted material. 


PICTURES


KuluBadu Plus aims to include up-to-date pictures of all of the goods on this web site.  We have made every effort to display the true colours of the item, but this may vary due to computer settings, etc.   We recommend you read the labels on the goods carefully before using the goods. 



PRIVACY

KuluBadu Plus will comply with KuluBadu Plus’s Privacy Statement.  KuluBadu Plus will not reveal your personal information to external organisations except for the purposes of fulfilling your order. 



LIABILITY

The material in the Site is provided for informational purposes only.

You agree to defend, indemnify, and hold KuluBadu Plus harmless from any and all suits, actions, legal or administrative proceedings, claims, demands, damages, liabilities, and expenses, including attorney’s fees and costs, arising in connection with a violation of this Agreement by you or through use of your account.

CHANGES TO TERMS 


Each order is governed by the terms and conditions current when the order is placed.  KuluBadu Plus may add to, delete or otherwise change these terms and conditions without notice.  It is your responsibility to read and understand these terms and conditions each time you place an order.

This Agreement is effective upon your acceptance as set forth herein and shall continue in full force and effect until terminated.  KuluBadu Plus may suspend or terminate this Agreement or the KuluBadu Plus Service or remove or disable access to any portion of our service at any time for any reason with or without notice to you.

APPLICABLE LAW 


All purchases under this mobile application and these terms and conditions are subject to the laws of Sri Lanka.


PAYMENTS

We accept cash and credit/debit cards.  In the event your card is declined, we reserve the right to collect funds for any uncollected transactions owed us.  If you fail to pay any fees or charges when due, we may suspend or terminate your access to our Service. You shall be responsible and liable for any fees, including but not limited to attorney’s fees and collection costs, that we may incur in our efforts to collect any unpaid balances from you.

We make no representations or warranties of any kind, express or implied, regarding the merchandise received from other suppliers and the fact that we make their products available should not be construed as an endorsement of these businesses or the products they provide.

Payment is expected upon delivery if paid in cash or in advance at the time of placing the order if credit/debit card is used.  Identification may be requested when collecting goods.  Payment details shall be finalized prior to dispatch unless you have an approved account.  
Please do not use Post Office Box numbers as your delivery address. 



DELIVERY ADDRESS AND CONTACT DETAILS


When placing an order with us, where we are to deliver goods to you, we require a physical street address and to better serve you we also request that you mark your location as accurately as possible when adding a delivery address. To assist us in processing your order, please keep your telephone number up to date in your account.  We cannot deliver to a post office box address.
